Pakistan – WGAD OPINION – Mesut:Meral Kacmaz (ENG) A_HRC_WGAD_2018_11

In this opinion, the UN Working Group on Arbitrary Detention finds that the arrest, secret detention, and forcible deportation of Mesut Kaçmaz, Meral Kaçmaz, and their two minor children from Pakistan to Turkey were carried out without legal basis and in defiance of a domestic court order. The Working Group concludes that Pakistan and Turkey jointly violated due process, non-refoulement, and children’s rights, determining the deprivation of liberty to be arbitrary under multiple categories and calling for release, compensation, and accountability.
