WOMEN’S RIGHTS VIOLATIONS BY THE TURKISH LEGAL SYSTEM

The intent of this report is to declare the victims of the ‘New Turkey,’ especially women with children who have been under persecution since the July 15, 2016 coup attempt. Although the Turkish government does not promote transparent data on the number of children imprisoned with their mothers, there are 864 children in the prison according to the Justice Department Prison and Penitentiaries Management. The ages of these children vary between newborns to 6 years, as of May 24, 2019.

TAKE ACTION ; Vigil in remembrance of those who died in the Aegean Sea while fleeing from the persecution in Turkey.

On Friday, September 27, 2019, the boat carrying desperate people fleeing persecution in Turkey sank. Seven out of 19 people on the boat passed away.

Funerals were held and 2 of the deceased were buried on the slope of Chios with the help of Greek citizens.

While the Greek media published the news as, “The angels escaping from Erdogan lost their lives in the Aegean Sea,” about the unfortunate event, the Turkish media used inappropriate name-calling.

Please join us on Saturday, October 26, 11:00 am -1:00 pm in Bryant Park, New York in remembrance of those who died in the Aegean Sea.

After the collective prayer for those who passed away, flyers with information about this sad event will be distributed.  Cookies will be shared for the benefit of those who passed away.

In Turkey, 278 people have already died due to not being able to stand the persecution, having heart attacks and other serious medical conditions, from torture, while fleeing from persecution, after car accidents, or by the struggle for survival under difficult conditions.

Don’t be silent about this persecution! Take action and come to Bryant Park on Saturday, Oct. 26!

Imprisoned children in Turkey | DW Documentary (Prison documentary)

2-year-old Miraz lives with his mother – in a Turkish prison. His mother is a Kurdish activist who was handed down a 4-year sentence for ‘terrorist propaganda’. He spends the weekends outside with his father, who does what he can to give Miraz a normal life.

In the last 2 years, over 160,000 people have been jailed in Turkey as part of purges by the government. Human rights organizations estimate they include 700 children, imprisoned along with their mothers. One of them is 2-year-old Miraz. His mother is a Kurdish activist who was handed down a 4-year sentence for ‘terrorist propaganda’. He spends the weekends outside with his father, who does what he can to give Miraz a normal life. Life behind bars takes its toll on children. Experience has shown that it leaves them traumatized and anxious. AST STATEMENT REGARDING GRAVE HUMAN RIGHTS VIOLATIONS IN TURKEY ON
HUMAN RIGHTS DAY, DECEMBER 10

Under the state of emergency, imposed after the July 2016 attempted coup and lifted on July 2018, President Erdogan presided over the cabinet, which could pass decrees without parliamentary scrutiny or the possibility of appeal to the constitutional court. Many decrees adopted contained measures that undermine human rights safeguards and conflict with Turkey’s international human rights obligations. The routine extensions of the state of emergency within two years have led to profound human rights violations against hundreds of thousands of people – from arbitrary deprivation of the right to work and to freedom of movement, to torture and other ill-treatment, arbitrary detentions and infringements of the rights to freedom of association and expression.

The Erdogan government is showing disregard to the rights of its dissidents. Approximately 217,000 people are detained and over 82,000 people are arrested on terrorism charges. Those prosecuted include journalists, civil servants, teachers, politicians, academics, human rights defenders as well as police officers and military personnel. The prosecutions often lack compelling evidence of criminal activity. Thereby the State officials use torture and ill-treatment in custody, including severe beatings, threats of sexual assault and actual sexual assault, electric shocks, waterboarding and interference with medical examinations.

Public officials continued to be dismissed or suspended by decree without due process, with more than 170,000 dismissed since July 2016. Those dismissed from their jobs lost their income, social benefits, medical insurance, and even their homes, as various decrees stipulated that public servants “shall be evicted from publicly-owned houses or houses owned by a foundation in which they live within 15 days”.

Websites including Wikipedia are blocked. Hundreds of media outlets, associations, foundations, private hospitals, and educational establishments that the government shut down by decrees are still closed, their assets were confiscated without compensation. The states of emergency have been used to severely and arbitrarily curtail the human rights of a very large number of people which is also declared by the UN High Commissioner for Human Rights Zeid Ra’ad Al Hussein.

One of the most alarming actions of the Turkish authorities is incarceration of women who are pregnant or have just given birth. Some are incarcerated with their children and others violently separated from them. At this moment, seven hundred forty-three (743) children under the age of six are in jails across Turkey with their mothers, detained or arrested as part of the government crackdown on its dissidents. One hundred forty-nine (149) of these children are infants under a year old. “This is simply outrageous, utterly cruel, and surely cannot have anything whatsoever to do with making the country safer” as the UN High Commissioner for Human Rights Zeid Ra’ad Al Hussein” also emphasized.

Another alarming action of the Turkish government is the overseas operations conducted by Turkey’s National Intelligence Organization (MIT) to capture perceived political opponents of President Erdogan’s administration. Abductions are perpetrated by violating international legal norms.

We, as Advocates of Silenced Turkey (AST), want to emphasize our deep concern and make you aware of human rights violations in Turkey. We want the Turkish government to change its seizure policies and reinstitute human rights all over the country and follow the rule of law. Turkey is in breach of its International Law Obligations. We, as AST urge you to address this situation and attract attention to it in your official capacity. AST urges to stand against the unlawful practices of the Turkish government after the failed coup attempt in July 2016.

In this regard, we call upon the Government of the Republic of Turkey to:

● Stop arbitrary arrests, detentions and wrongful prosecution of political prisoners and release them;

● Stop arbitrary arrests, detentions and wrongful prosecution of women and children;

● Stop illegal overseas operations to capture perceived political opponents;

● Stop, prevent and punish the use of torture and ill-treatment by State officials;

● Reinstate, those wrongly detained, prosecuted and dismissed from their posts;

● Ensure and safeguard the independence of the legal profession.

There are 624 children under the age of six in prison

The Justice Ministry announced that there are 624 children under the age of six staying in prisons with their mothers. There are 111 babies under age of one in prisons, and 157 children aged between one and two years old. This number increased by 20% compared to last year. It is also reported that 51 of the children in prison are non-Turkish nationals.

Another Turkish Woman Detained On Coup Charges One Day After Giving Birth

Fatma Türkmen, who gave birth to a baby in Ankara on Monday, was reportedly detained on Tuesday over alleged links to the Gülen movement.

According to a Twitter account, @Odak2014, police came to the hospital several hours after Türkmen gave birth to her baby, and took her to a police station in Ankara for interrogation. The mother was allegedly refused by police to see her newborn baby. The claim has neither been confirmed nor denied by the Turkish authorities.

This is not the first-time Turkish police detained a woman shortly after giving birth, as part of an ongoing investigation into the alleged followers of the Gülen movement.

In July, Rümeysa Doğan in an Antalya hospital and Ayşe Kaya from Edirne province were detained by police after delivery.

On June 2, Elif Aslaner, a religious education teacher who gave birth to a baby May 31 at a private hospital in Bursa province, was detained due to alleged links to the Gülen movement.

In May, Aysun Aydemir, an English teacher who gave birth to a baby in an elective cesarean procedure, was detained at the hospital and subsequently arrested by a court and put in pretrial detention with a 3-day-old baby in Zonguldak province as part of the witch-hunt targeting the Gülen movement.

In late January, Fadime Günay, who gave birth to a baby, was detained by police at Antalya’s Alanya Başkent Hospital.

In early January, Ş.A., a former private school teacher and mother of a week-old premature infant, was taken into police custody over links to the movement while she was on her way to the hospital to feed the baby.

A day after Ş.A. was taken into police custody, another woman known as Meryem gave birth to twins by C-section at a hospital in Konya and was detained by police despite hospital reports said that she should not travel and was taken to Aksaray from Konya in a police car.

According to recent data released by the Ministry of Justice, 668 children aged between 0 to 6 are being held in prison along with their parents.Turkey’s Justice Ministry announced on July 13 that 50,510 people have been arrested and 169,013 have been the subject of legal proceedings on coup charges since the controversial military coup attempt on July 15, 2016.
