Seriously ill educator still held in Manisa prison for 22 months

Isa Kara, 54-year-old, has worked 34 years as a teacher and director of Ministry of National Education’s Manisa provincial directorate. He was fired from his job with a decree issued by the Turkish government after the alleged coup attempt in July 2016.

Kara was imprisoned in October 2016 on coup charges. Despite his illnesses, he was held in pre-trial detention for 29 days and later transferred to Manisa prison. Kara is partly paralyzed and suffers from serious heart problems. Kara’s doctor had indicated that he needs to stay away from stress due to his heart problem. In an e-mail, it is claimed that two months before he was put in pre-trial detention, he had his first Angiogram. On April 12, 2018, he was transferred by the prison management to İzmir Katip Çelebi University Hospital where he had his second Angiogram. After spending 45 days in the hospital, he was sent back to İzmir Buca F Type Prison.

Kara’s family submitted 15 requests for the release of Isa Kara due to his health condition, however, all of them were rejected. The prison conditions are not satisfactory for the well-being of Kara. The prisons are overcrowded and are not sanitary for such a seriously ill patient. Kara’s doctor has noted numerous times that Isa Kara is not receiving proper treatment under current prison conditions.

Mr. Kara is being accused of membership in the Gülen movement, accused by the Turkish government of masterminding a coup attempt on July 15, 2016. The movement denies any involvement, and the Turkish government has rejected parliamentary motion to investigate the coup. Right after the coup, without any just hearing, the Turkish government initiated a widespread purge against the sympathizers of the movement.

There have been many cases of suicide and death in prison, some of which were found to be suspicious, of people who have been affected by the purge of Gülen movement followers. Isa Kara’s family is in the apprehension of severe worries about his health condition as they reminisced about the victims who died for they were not given proper and necessary treatment and were supposed to be given parole due to fatal conditions in jail.

A Rogue State Under Erdogan: Turkey’s global witch-hunt and unlawful abductions of dissidents abroad

The Turkish government has been conducting a witch-hunt against the dissenting groups under the state of emergency since the coup attempt in July 2016.

Recently, Turkey has been hunting down individuals living in other countries.

Teachers, doctors, businessmen, mothers, and children, who legally work and live in different countries away and disconnected from the unrest in Turkey, are abducted through clandestine plots and unlawfully handed over to the Turkish government.

Here are some of the criminal “rogue state” activities conducted by the members of the Turkish intelligence and consular staff upon the orders of President Erdogan.

Mustafa Ceyhan Abducted in Front of the Courthouse

Mustafa Ceyhan is a businessman from Turkey who resides in Georgia with his family under UN protection. He visited Azerbaijan from Batumi (Georgia) on 4/20/2017 for a business trip. Once he entered Azerbaijan, he was unjustly arrested on charges of illegally crossing the border to Azerbaijan.

On April 26th, Ceyhan was brought before court in Baku. The trial date was rescheduled to an earlier date, and happened without a notice to his lawyers. His lawyer, Tural Emenov and another lawyer appointed by the United Nation found out about the trial and accompanied him. The judge acquitted him from charges pressed against him.

Ceyhan’s wife, Meryem Ceyhan indicated that as Ceyhan was leaving the court around 12:00 PM, he was abducted in front of the courthouse by a group of eight men in a black Range Rover with black tinted windows. His whereabouts are unknown since then. His family and friends are worried about his condition and fear that he may be illegally sent back to Turkey where he faces risks of torture and ill-treatment.

Ceyhan’s lawyers called the United Nations mission in Baku, Azerbaijan and requested assistance, however, representatives there told them that they could not do anything. They told them to deal with it on their own.

The Turkish government had accused Ceyhan of having ties to the Gulen Movement (also known as Hizmet Movement) and appealed to Azerbaijan to extradite Ceyhan. Alleged supporters of the Movement in Turkey have been dealing with arrest, imprisonment, torture, inhuman and degrading treatment, confiscation and passport seizure. There are many examples of abductions and physical violence incidents in several countries like Sudan, Kazakhstan, Pakistan, Georgia, Myanmar, Malaysia and most recently in Kosovo. President Erdogan has on numerous occasions explicitly praised the abductions and promised more abduction in near future.

We urge international bodies and human rights organizations to take all necessary steps to find Mustafa Ceyhan and prevent his extradition to Turkey.

Groom detained for ‘insulting’ Erdoğan, bride performs ceremony alone

A groom named Rahat Akbaba was detained for “insulting” President Recep Tayyip Erdoğan on henna night, a customary celebration before a wedding, in Turkey’s Diyarbakır province, causing the wedding ceremony to be held with just the bride, the Mezopotamya news agency reported.

According to the report, Akbaba’s car was stopped on April 5 by counterterrorism units on his way from the hairdresser to the henna night party with his bride, Sara Başak. Akbaba was taken to a courthouse and later to Diyarbakır Prison after he was informed that a sentence of three years, nine months in prison for insulting President Erdoğan had been approved by an appeals court.

But their families held the henna celebration and later the wedding ceremony on April 6 as previously planned. Başak performed all the rituals alone.

“They could not tolerate our happiest day. They made the arrest intentionally on henna night. During our talk at the courthouse, he [Akbaba] wanted us to hold the wedding ceremony. We did so out of spite,” said bride.

Twenty-seven social media messages that Akbaba has posted on social media since 2012 were judged to be insults to President Erdoğan by the court.

Turkish Teachers in Afghanistan

The National Directorate of Security (NDS), Afghan intelligence agency, abducted four teachers including one Afghan and three Turkish nationals from one of the schools run by the Afghan Turk CAG Educational NGO (ATCE) on 12 December 2017. While three Turkish nationals and one Afghan teacher were released, two Turkish nationals are still under house arrest and face possible deportation to Turkey.

The ATCE was founded by Gulen inspired Turkish businessmen and teachers and has been running several schools in different cities of Afghanistan since 1995. Despite all the difficulties in the region, the ATCE has continued to maintain its services believing that education is the only way to overcome those difficulties.

Former Deputy Minister of Education, Sediq Patman classified the situation as “politically motivated and unethical.” Former NDS chief has also defined the move as unprecedented in recent years, also as a shameful act for the government. According to former government officials, the raid by the NDS was illegal in the sense that the security forces have been used by the government leaders for political objectives. Despite these statements, there has not been an official comment on the incidence, neither by the government nor the intelligence agency.

Moreover, Afghan President Ashraf Ghani traveled to Istanbul a day before the incidence (12/11/17) to attend a summit organized by the Organization of Islamic Cooperation. Ministry of Education said, “it was satisfied with the functioning of these schools, but decision on their fate rested with President Ghani.” Reportedly few days before the operation, the Turkish government announced arrest warrant on teachers’ name for taking part in the so-called coup attempt. Documents indicate that the UN has provided asylum protection to one of the abducted teachers and asked authorities not to extradite him to Turkey.

The operation against the ATCE is part of a Turkish campaign against the followers of Fethullah Gulen who is a Turkish cleric which lives in self-imposed exile in the U.S. He promotes a moderate form of Islam, supports inter-faith communication and inspires to promote education in different parts of the world. Turkish President Recep Tayyip Erdogan accuses him of orchestrating the failed coup-attempt. Mr. Gulen has strongly been denying all the allegations.

As the Advocates of Silenced Turkey, we strongly request your assistance to remind the Afghan authorities to ensure that the individuals at risk avoid expulsion in Turkey, where they would, with a great deal of certainty, be subject to torture and ill-treatment. We do believe that this is also an important moment to act in accordance with the Constitution of Afghanistan and relevant provisions of accepted international human rights treaties, in particular, CAT Article 3. We further believe that this is also an opportunity to demonstrate Afghanistan’s resolute commitment to upholding the highest standards in the promotion and protection of human rights, ahead of its upcoming UN Human Rights Council membership.
